What Is A Creditor's Statutory Demand?

A creditor’s statutory demand is a formal demand made by a creditor against a debtor company in reliance upon a debt that is more than $2,000.

The debtor company must comply with the creditor's statutory demand within 21 days from the date of service by paying the debt referred to in the demand or applying to set aside the demand.

Should I Issue A Creditor's Statutory Demand?

Prior to issuing a creditor’s statutory demand, you should consider the following important factors:

– Is the debtor a registered Australian Company?

– Does the debtor owe me more than $2,000 Australian Dollars?

– Is there any dispute about whether or not the debtor owes me the debt?

Given the severity of these types of demands, we generally recommend obtaining legal advice prior to issuing a creditor’s statutory demand.
